Creation of Occupational safety and health regulations

According to the Occupational Safety and Health Act, the employer’s duty is to ensure compliance with the requirements for safe and health-protecting work conditions.

To this end, the employer regulates the tasks and their implementation as specified by law. The preparation of the Occupational Safety and Health Regulations requires responsible preparation, coordination, and alignment.

Some regulatory areas qualify as occupational safety and health activities, so it is advisable that a safety expert drafts the occupational safety regulations.

The occupational safety regulations must be integrated into the employer’s system of rules, ensuring proper harmony with the organizational and operational regulations, collective agreements, other instructions, and the occupational safety regulations.

Employer instructions that define how occupational safety requirements are to be met, such as the occupational safety regulations, are considered binding regulations. Any violation of these provisions carries responsibility.

A well-prepared and appropriately tailored occupational safety regulation can save significant time and energy for our clients.

The occupational safety training curriculum is essential for conducting successful theoretical and practical training. For lifting equipment, particular emphasis must be placed on the occupational safety training curriculum, the development of which is considered a work safety specialist activity according to the relevant regulations.

According to the occupational safety law, the employer is required to have a risk assessment, in which they are obligated to qualitatively, and if necessary, quantitatively assess the risks to the health and safety of employees, with particular attention to the tools used, hazardous materials and mixtures, the burdens on employees, and the design of the workplaces.

If the activity takes place within the framework of organized work and the employer has at least one employee, a risk assessment is required to be carried out, even if the activity is not hazardous.

The employer must carry out the risk assessment, risk management, and define preventive measures – unless otherwise specified by law – before the start of the activity, after that, in justified cases, but at least every 3 years.

The risk assessment must be performed as a matter of urgency if a work accident, increased exposure, or occupational disease occurred in connection with deficiencies in the applied activity, technology, tools, or work methods, or if the risk assessment did not cover aspects defined by other laws. Conducting the risk assessment is considered a safety and occupational health specialist activity.

In most cases, the occupational safety risk assessment means the systematic review of existing safety requirements, the elimination of shortcomings, where the main tools are comprehensive knowledge in the field of occupational safety and common sense.

The concept and tasks of the occupational safety risk assessment are defined by the occupational safety law, and the employer’s obligations for risk assessments are aligned with it.

Based on the risk assessment, preventive measures need to be taken to improve working conditions, which will be integrated into all levels of the employer’s management activities. The occupational safety risk assessment is closely related to the prevention of hazards, which must be based on identifying and assessing risks. Therefore, the occupational safety risk assessment is a central and essential element of the employer’s occupational safety activities and the foundation of hazard prevention.

Our company undertakes the development of the distribution system for personal protective equipment, which, according to the relevant legislation, is considered an occupational safety and health activity. The creation of the personal protective equipment distribution system is mandatory for every employer where the use of personal protective equipment is required for work, based on the risk assessment. The issuance and collection of personal protective equipment for employees must be documented, and the occupational health service must also be involved in its preparation.

We undertake the preparation of the occupational safety content of the occupational medical fitness assessments procedure, and also consult with the occupational health service provider regarding the scheduling of the assessments. The frequency of the occupational medical assessments will be recorded in the medical fitness procedure, with the aim of clearly identifying in the future the frequency at which employees working in a specific position need to attend the assessments.

Every job, even in the simplest cases, requires certain abilities that employees must possess in order to perform the given task.

In Hungary, the legal regulations prescribe that every employee must undergo an occupational medical fitness assessment. The purpose of the assessment is to determine whether the employee can endure the physical and mental strain associated with the job over the course of the employment.

The employer is required to commission hazardous machines. A prerequisite for the occupational safety commissioning is the conducting of an occupational safety preliminary inspection. The purpose of this inspection is to determine whether the facility, workplace, work equipment, and technology meet the necessary conditions for safe and health-protecting work, including material, personnel, organizational, and environmental factors.

The performance of this inspection is considered an occupational safety and occupational health specialist activity.

Our company undertakes the preparation for the commissioning of hazardous/non-hazardous facilities, machines, equipment, and work tools, as well as the conducting of the occupational safety preliminary inspection.

The rescue plan must be developed based on abnormal circumstances – when the safety regulations related to normal operation cannot be adhered to – considering the nature of the workplace, its location, extent, and the impact of the hazards. It is necessary to create for every employer where the established hazardous situation requires increased organization, or where appropriate personnel and equipment must be provided to restore normal operations. The rescue plan should designate the personnel required for the rescue, and the plan must be practiced with the rescuers and communicated to the workers on the site.

In order to ensure health and safe work, the employer is required to establish a unified and comprehensive prevention strategy that covers the work process, technology, work organization, working conditions, social relations, and the effects of workplace environmental factors.

The goal of the prevention strategy is to meet the requirements for health-safe and safe work, as well as to ensure that the short- and long-term risks of work do not exceed an acceptable level for the health and safety of employees.

According to the provisions of the Occupational Safety Act, the investigation of workplace accidents is considered a safety-related professional activity. The experts of Prevenor Standard Kft. carry out the activities related to investigating workplace accidents and handle the administrative tasks associated with them. It is advisable to entrust the investigation to a qualified person in order to uncover the causes leading to the accident and prevent similar accidents in the future.

The employer is obligated to investigate and record any injuries or accidents that come to their attention within three years. The investigation of the accident must begin immediately after the event occurs. A delayed investigation can make it difficult to reconstruct the circumstances of the accident, and in some cases, changes to the site may make it impossible to identify all the hazards, including the direct causes of the accident, thus hindering the prevention of similar accidents.

Workplace accidents must be recorded in the employer’s accident register (accident log). If the accident is expected to result in incapacity for work, it must be investigated, and the results of the investigation should be documented in a report. Depending on the duration of the incapacity, the accident must also be reported to the authorities.

The investigation should always take place at the scene of the accident, as verbal inquiries are not sufficient. Based on the investigation, a report must be written. If necessary, witnesses must also be heard.

Following the investigation and the identification of cause-and-effect relationships, an “Accident Report” must be created for the workplace accident.

If your company uses hazardous materials, you may need a chemical risk assessment. Our company undertakes the preparation of risk assessment documentation, including the chemical risk assessment.

According to the occupational safety law, the employer must have a risk assessment, in which they are required to qualitatively and, if necessary, quantitatively assess the risks to employees’ health and safety, with particular attention to the tools used, hazardous materials and mixtures, the loads on employees, and the design of the workplace.

In the risk assessment, if an etiological factor regulated by health protection limits occurs, work hygiene tests must be carried out to determine the level of exposure.

The employer is required to perform the risk assessment before starting the activity, subsequently if necessary, but at least every 3 years, every 2 years in the case of activities involving carcinogenic substances, and annually in the case of biological risks.

Carrying out and documenting occupational safety inspections

Occupational safety inspections are essential prerequisites for ensuring conditions that do not jeopardize health and allow for safe work. During the inspections, we identify the causes of hazards, enabling timely prevention of accidents and emergencies. We offer nationwide services for conducting site inspections, documenting them, and providing recommendations to address the identified deficiencies.

The employer operating the workplace, personal protective equipment, tools, and technology must urgently inspect them:

a) if they directly endangered the health and safety of the employee during normal use, or if a work accident occurred in connection with this, or

b) in the event of extraordinary circumstances (especially modifications, accidents, natural phenomena, or technical reasons leading to a period of unavailability lasting more than 30 days).

Until the inspection is completed, the operation or use of the workplace, personal protective equipment, tools, and technology must be prohibited. The completion of the inspection, depending on the nature of the hazard, is considered a work safety or occupational health expert activity.

The regulations set strict review requirements for both hazardous and non-hazardous machinery. We assist you in determining the categories of hazardous machines, as well as in scheduling and regulating the frequency of reviews, and in carrying out and documenting the inspections.
